Terms of Service for The Private Club App

Welcome to The Private Club mobile application (“App”), operated by The Private Club App (Pty) Ltd (“we,” “us,” or “our”). By accessing or using our App, you (“User,” “you”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing, browsing, or using The Private Club App, you confirm that you understand, accept, and agree to these Terms. These Terms apply to all users of the App.

2. Description of the Service

The Private Club App allows users to browse and book hand-picked personnel for various events. Our App provides profiles of available personnel for hire. Please note:

• No Payment Processing: The App does not handle any payments. Payment transactions, if any, will occur outside the App between you and the personnel or through a third party.
• No Obligation on Confirmation: Confirming a booking through the App does not create a binding obligation for us to fulfill the booking. All bookings are subject to our review and discretion.

3. Booking Discretion and Cancellations

• No Guarantee of Booking Fulfillment: While we strive to connect you with available personnel, confirming a booking on our App does not guarantee that the personnel will be provided or that the booking will proceed. We reserve the right to cancel or modify bookings at any time based on our discretion.
• Cancellation Policy: We may cancel any booking for any reason, including but not limited to scheduling conflicts, availability issues, or other unforeseen circumstances. In such cases, you will be notified as soon as possible. We shall not be liable for any losses or damages resulting from cancellations.

4. User Responsibilities

• Accurate Information: When browsing profiles or confirming bookings, you agree to provide accurate and truthful information.
• Compliance with Laws: You agree to use the App in compliance with applicable local, state, national, and international laws and regulations.

5. Liability Disclaimer

All content, including text, design, graphics, and logos, featured on The Private Club App are the property of The Private Club App (Pty) Ltd or its licensors. You are not granted any rights to use, modify, or reproduce this content without prior written permission.

6. Changes to the Terms

We may update these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms on the App. It is your responsibility to review these Terms periodically. Continued use of the App after changes constitutes your acceptance of the new Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in South Africa.

9. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, the App, or third parties.
